Privacy Complaints by European Union Citizens: 7 Hour Patch complies with the EU-U.S. Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries transferred to the United States pursuant to Privacy Shield.  7 Hour Patch has certified that it adheres to the Privacy Shield Principles with respect to such data.  If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. PLEASE NOTE: If you choose to stop receiving promotional messages from us, we will honor your request. However, we will continue to send you service-related communications as authorized by law. Web Beacons:  Web beacons are small bits of code embedded in web pages or in emails. We may use web beacons to deliver or communicate with cookies, to count users who have visited a web page, and to understand usage patterns. We also may include web beacons in e-mails to learn if messages have been opened, acted on, or forwarded.

You can disable the ability of web beacons to capture information in this manner by declining cookies as described above.

Other Technologies:  Examples of other technologies we may use to provide better service to you follow:

Web Session Variables: Information that is passed from one web URL to another as you browse.

Browser plug-ins/add-ons: Additional web components that may need to be installed to enable certain web features on our sites. You have the option not to install these components.

Third-Party Advertising:  We may allow third parties, including business partners to display advertising on our sites. Some of these companies may place a cookie on your computer to recognize your computer each time they send you an online advertisement. This enables them to understand where you, or others who are using your computer, saw their advertisement and deliver ads that they believe are of interest to you. We do not control these companies’ use of cookies.

The success of our business depends on your trust, and we do not sell your personal information to marketers outside of 7 Hour Patch unless we have asked for and obtained your consent. We share your personal information only as described below and within 7 Hour Patch.

Third-party service providers: We rely on third-party service providers to perform a variety of services on our behalf and may need to share your personal information with them. Please note that we provide our service providers with only the personal information they need to perform their services and we require that they protect this information and not use it for any other purpose.

Other situations we may disclose your personal information:

Where permitted by law, to protect and defend the rights and property of 7 Hour Patch (including enforcing our Terms and Conditions and Agreements).

And when required by law, and/or public authorities.

Aggregated and non-personal information:  We may share aggregated information that does not identify you for general business analysis. For example, we may disclose the number of visitors to 7 Hour Patch sites or services.

Pursuant to the Privacy Shield, 7 Hour Patch remains liable for the transfer of personal data to third parties acting as our agents unless we can prove we were not a party to the events giving rise to the damages.

 

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • The performance of the contract between you and the Site;

Retention

 GDPR

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.  Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

 

Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

 

California Residents (CCPA)

If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Nevada Residents

Nevada law gives Nevada consumers the right to request that a company not sell their personal information for monetary consideration to certain other parties. This right applies even if their personal information is not currently being sold. Additional Notice Regarding U.S. State-Specific Privacy Rights

Many states have enacted specific privacy policy laws. This section of our Privacy Policy applies to individuals who reside in the states in which state-level privacy law is enacted (e.g., Colorado, Virginia, etc.) other than California. Targeted Advertising.

Like many companies, we process personal information for targeted advertising, including by disclosing certain identifiers such as email addresses and pseudonymized identifiers, information about the use of our online services, and inferences drawn about online services users to our business partners such as social media, advertising, and analytics providers. Under certain state laws, this may be considered as a sale of personal information for valuable consideration and/or the sharing of personal information for targeted advertising. You can opt-out of such targeted advertising by visiting the Digital Advertising Alliance website or the Network Advertising Initiative website. You can also opt-out of targeted advertising by (a) selecting Do Not Sell or Share My Personal Information and submitting an opt-out request to us, or by (b) selecting Cookie Settings on 7 Hour Patch’s website and disabling cookies. 7 Hour Patch will also process opt-out requests submitted by a consumer’s opt-out preference signal as required by applicable law.

Privacy Rights.

Under applicable law, you may have the following rights, in each case under the conditions and to the extent set out in applicable law:

  • Right of Access: A right to confirm whether we are processing personal information about you, and to request to access such personal information (including, if applicable, in a portable and readily usable format).
  • Right of Correction: A right to correct inaccuracies in certain personal information we may hold about you.
  • Right of Deletion: A right to request that we delete personal information concerning you. Please note that if you have requested a service that requires the use of your personal information, we may not be able to provide that service if you choose to delete your personal information.

As required or permitted under applicable law, please note that we take steps to verify your identity before acting on your request to exercise your rights. To verify your request, you must provide your name and email address. If we believe we need further information to verify your request as required by law, we may ask you to provide additional information to us.

We may limit our response to your exercise of the above rights as permitted under applicable law. If your rights request is denied, applicable law may give you a right to lodge an appeal with us. The response to your rights request will inform you of any appeal rights you may have, and tell you how you can exercise them.

You may designate an authorized agent to request any of your rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us as set forth in the “Resolving Your Privacy Concerns” section of this policy to make a request on your behalf. Even if you choose to use an agent, as permitted by law, we may require verification of the agent’s authorization to act on your behalf, require you to confirm you have authorized the agent to act on your behalf, or require you to verify your own identity.

 

Information Security

We are committed to keeping personal information secure. We have appropriate technical, administrative and physical procedures in place to protect personal information from loss, misuse or alteration.

We limit access to personal information to those who have a business need. We keep personal information only for a reasonably needed amount of time.

When we provide your personal information to our third-party service providers we require those companies to protect the information and to not use the information for any other purpose.

When we collect or transmit sensitive information such as a credit card number, we use industry standard methods to protect that information.

Please note that we may be required to release an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

 

Information Transfer

Your personal information may be transferred to, stored, and processed in a country other than the one in which it was provided. This may include the United States. When we do so, we transfer the information in compliance with applicable data protection laws.

We take steps to protect personal information.  Regardless of where this information is stored or transferred, we have the appropriate procedures and controls to help ensure your personal information is protected.

We adhere to country data privacy laws including the EU Data Privacy Directive, as well as the U.S. Department of Commerce EU-U.S. Privacy Shield.

We may transfer personal information to 7 Hour Patch databases in countries other than where it was provided. Our Global Privacy Program requires the same high level of security and protection of personal information in all geographies with procedures and contracts in place to help ensure this is so. Data may be transferred to a vendor or business partner to provide services for 7 Hour Patch, such as targeted email communications, mailing information or samples. These vendors and business partners are required to protect and manage the personal information to the same high standards 7 Hour Patch does, and they cannot use the information for purposes other than to provide the services 7 Hour Patch has requested.

 

Children's Online Privacy

We believe it is important to provide added protection for children online. We encourage parents and guardians to spend time online with their children to participate in and monitor their online activity.

We do not intend to collect personal information from children under the age of 14.

We ask for an age confirmation in connection with the collection of personal information on our web sites in order to avoid the collection of information from individuals under the age of 14.

 

Changes to This Privacy Policy

We will post changes to this Privacy Policy and update the effective date when this Policy or the Global Privacy Statement is updated.
